It would be interesting whether a toy is "useful article" or "artistic work". I would imagine it is a useful article given it is sold presumably to play with, rather than sit in a display case.
We need to stop thinking copyright (as perceived for written works and music/film) applies in the real world, otherwise corporatism will try it on and ask for more laws and remove out existing rights. I can see it coming.
